The Company rates and services are
fixed for the duration of the supply of goods and services and are subject
to review on an annual basis.
The rates and prices referred to in
Note 1 above are based on free and uninterrupted access to the site and,
unless expressly set out otherwise, a single consultants’ visit
In the event of any conflict between
any terms of any order raised by a client and their standard terms of
business, it shall be an express term of any such contract that that these
terms shall take precedence. For the avoidance of doubt, Martec
Environmental Consultants Ltd will not enter into any Agreement without the
incorporation of those terms.
Title to any goods or services
provided by Martec Environmental Consultants Ltd shall not pass to any other
person or Company until all invoices in respect to such goods and services
and in particular Building Regulations’ Sound Insulation Tests certificates,
reports and other documentation, until payment has been received in full by
Martec Environmental Consultants Ltd.
Payment shall be made on or before 30
days from the date of Martec Environmental Consultants Ltd invoice, unless
otherwise stated in the quotation.
Martec Environmental Consultants Ltd
shall provide Professional Indemnity Insurance to the sum of £1,000,000
sterling.
Unless expressly agreed to the
contrary, reports shall be issued to the client upon receipt of payment of
the sum due to Martec Environmental Consultants Ltd for the goods and
services provided.
In the event of sums not being paid in
accordance with Note 5 of the terms and conditions Martec Environmental
Consultants Ltd shall be entitled to interest in accordance with The Late
Payment of Commercial Debt (Interest) Act 1998 at 8% above the Bank of
England base rate, compounded annually.
Any relaxation of any terms by Martec
Environmental Consultants Ltd during the course of the contract should not
be construed as a waiver of any right of Martec Environmental Consultants
Ltd to rely upon such a term in the future.
The scope of work should be clearly
set out in Martec’s quotation; any changes to such scope shall be instructed
in writing by the client. Martec Environmental Consultants Ltd shall not be
required to undertake any additional and/or varied work until a price is
agreed for such works in advance of their execution.

rates and prices are exclusive of any VAT which shall be charged at the
appropriate rate.
